Takedown Policy - Tono kia Tangohia mai i te Ipurangi

 

In making material available online the Methodist Church of New Zealand Archives acts in good faith.

 

However, despite safeguards, we recognise that from time-to-time material published online may be in breach of copyright laws, contain sensitive personal data, or include content that may be regarded as sensitive, objectionable, obscene, offensive, disturbing, or defamatory, or that could be considered harmful under the New Zealand Harmful Digital Communications Act 2015.

 

1. Please notify us in writing if you have found material on the Kei Muri Māpara website that you are concerned contains:

i. Content that breaches your copyright (or the copyright of a person for whom you are the authorised representative) and that is not covered by a limitation or exception.
ii. Your personal information for which you have not given permission, or that otherwise contravenes the Privacy Act 2020.
iii. Content that you consider sensitive, objectionable, obscene, offensive, disturbing or defamatory, or that could be considered harmful under the New Zealand Harmful Digital Communications Act 2015.

iv. Content that is culturally sensitive and making it available online is not appropriate or requires further consultation.

 

Your notification must specify the following:


i. Your contact details.
ii. The full Methodist Church of New Zealand Archives reference details of the material.
iii. The exact and full url where you found the material.
iv. If the request relates to copyright, provide proof that you are the rights holder and a statement that, under penalty of perjury, you are the rights holder or are an authorised representative.
v. The reason for your request.

 

2. Upon receipt of notification, this Takedown Policy is then invoked as follows:

 

i.      The Methodist Church of New Zealand Archives will acknowledge receipt of your complaint by email or letter and will make an assessment of the validity and plausibility of the complaint.

ii.    Upon receipt of a valid and plausible complaint, the material will be temporarily removed from the Kei Muri Māpara website pending a mutually agreed solution.

iii.  Following discussion between the complainant and the Methodist Church of New Zealand Archives, agreement will be made amicably and to the satisfaction of both parties upon one of the following possible outcomes: 


a) The material is replaced on the Kei Muri Māpara website unchanged. 
b) The material is replaced on the Kei Muri Māpara website with changes. 
c) The material is permanently removed from the Kei Muri Māpara website.

 

iv.  If the Methodist Church of New Zealand Archives and the complainant are unable to agree upon a solution, the material will remain unavailable on the Kei Muri Māpara website, until such time as an agreement is reached.
